1. Introduction

This website and web-application aushlc.com ("Service") is operated by Happy Simple (ABN 87 641 713 304) ("We / Company / Our") located in Australia. By using the Service you agree to be bound by these Terms of Service and the Privacy Policy. The Privacy Policy is available here: aushlc.com/legal/privacy.

These Terms of Service and the Privacy Policy (collectively "Terms of Use") apply to all users of the Service, including without limitation users who are browsers, vendors, customers, clients, merchants, volunteers, and/or contributors of content ("Users"). Please read them carefully.

Words used herein in the singular, where the context so permits, shall be deemed to include the plural and vice versa. The definitions of words in the singular herein shall apply to such words when used in the plural where the context so permits and vice versa.

2. Use of the Service

The Service is provided for the sole use of members of the Hospital Liaison Committees of Jehovah Witnesses ("HLC") and any user approved by a HLC.

You may use the Service only as permitted by your HLC, your local laws and regulations, and the laws and regulations of the country of Australia. Users who are not approved by a HLC are not permitted to use the Service.

If you do not agree with the terms stated herein you must discontinue the use of the Service immediately.

3. Privacy and Personal Information

To provide the Services to you we may need to record some personal information about you. We are committed to responsible privacy practices and to comply with the privacy principles contained in the Privacy Act 1988 (Privacy Act of Australia) to the extent they apply to the Company.

Some of your personal information may be visible to and managed by other Users of the Service. Users of the Service are responsible for the personal information that is collected and stored on the Service, including but not limited to the type of information, how it could identify a person, and the duration for which such data is stored.

Users of the Service must comply with all local privacy laws in addition to the privacy laws of Australia and our Privacy Policy found here: aushlc.com/legal/privacy.

Users of the Service must take all reasonable steps to keep personal information held in the Service safe. This includes but is not limited to using long complex passwords, multi-factor authentication must be enabled on their associated email account, and regularly changing their passwords.

4. Prohibited Uses

You are prohibited from using the Service or content arising from the use of the Service:

  • for any unlawful purpose;
  • to solicit others to perform or participate in any unlawful acts;
  • to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
  • to infringe upon or violate Our intellectual property rights or the intellectual property rights of others;
  • to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, ethnicity, race, age, national origin, or disability;
  • to submit false or misleading information;
  • to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, third-party service, or the Internet;
  • to collect or track the personal information of others that is outside of the intended use of the Service;
  • to spam, phish, pharm, pretext, spider, crawl, or scrape; or
  • to interfere with or circumvent the security features of the Service including related websites and third-party services used to provide the Service;
  • for any purposes related to commercial activity or marketing;
  • for any purposes or activities that are not in connection with and approved by a Hospital Liaison Committee of Jehovah's Witnesses.

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

5. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided and licensed "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranty of quality, merchantability, title, non-infringement and fitness for a particular purpose, and such implied warranties, any other warranties, representations, conditions and terms, express or implied (and whether implied by statute, common law, course of dealing, trade usage or otherwise) are hereby excluded to the fullest extent permitted by law.

We do not warrant that (i) the Service will meet your requirements, (ii) the use of the Service will be uninterrupted or error free, (iii) the Service will comply with regulatory requirements applicable to you, or (iv) appear or function precisely as described in any accompanying documentation.

You agree that you are solely responsible for the results obtained from the use of the Service.

Without limiting the generality of the foregoing disclaimer, the Service is not specifically designed, manufactured or intended for use in facilities or environments requiring failsafe performance, including but not limited to (a) medical and health related uses, (b) medical or health emergencies, (c) medical facilities and services, (d) direct life support systems, and you are solely responsible and expressly assume all risk for any such use.

You further acknowledge that there are certain security, corruption, transmission error and access availability risks associated with using open networks such as the internet and/or telecommunication lines or circuits. You hereby assumes all risks relating to the foregoing.

6. Disclaimer of Liability

Except as expressly set forth in this Terms of Use, neither the Company, nor its employees, contractors and other persons associated with the development and maintenance of the Service shall have any liability for any direct, indirect, incidental, special, exemplary, or consequential damages (including without limitation lost profits), however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use or distribution of the Service or the exercise of any rights granted hereunder, even if advised of the possibility of such damages.

Neither We nor the Service are part of the legal organizations of Jehovah's Witnesses or the Hospital Liaison Committees of Jehovah's Witnesses, nor do we make any representations indicating otherwise.

7. Applicable Law

This Terms of Use agreement will be governed by the laws of the state of New South Wales in Australia.

8. Severability

In the event that any term of this Terms of Use agreement which is wholly or partially void or unenforceable, it shall be deemed severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of this Terms of Use agreement is not affected and shall continue to be valid and enforceable.

9. About these Terms of Service

We reserve the right to update, modify, or revise these Terms of Use at any time, at our sole discretion. Any changes will be effective immediately upon posting the updated terms on this website or through other means of notification, as applicable. It is your responsibility to review these Terms of Use periodically to stay informed of any updates. By continuing to use the Service after any changes are posted, you agree to be bound by the revised Terms. If you do not agree with any modifications, you must discontinue use of the Service immediately.
