1. Introduction
This website and web-application aushlc.com ("Service") is operated by Happy Simple (ABN 87 641 713 304) ("We / Company / Our / Us") located in Australia.
This Privacy Policy governs the manner in which the Company stores and uses information collected from you to provide the Services. This Privacy Policy applies to all users of the Service, including without limitation users who are browsers, vendors, customers, clients, merchants, volunteers, and/or contributors of content ("User").
The Service is provided for the sole use for members of the Hospital Liaison Committees of Jehovah Witnesses ("HLC") and any user approved by a HLC.
Words used herein in the singular, where the context so permits, shall be deemed to include the plural and vice versa. The definitions of words in the singular herein shall apply to such words when used in the plural where the context so permits and vice versa.
2. What is Personal Information?
In this Privacy Policy, ‘personal information’ has the meaning set out in the Privacy Act of Australia ("Privacy Act") and includes information or an opinion about an individual who is reasonably identifiable ("Personal Information"). This could include your name, email address, telephone numbers and other personally identifiable data.
3. What types of Personal Information do we collect?
The types of personal information we collect from you depend on the circumstances in which the information is collected. We and Users of the Service may collect the following information:
- Contact and identification details including your name, email address, place of business, telephone numbers and religious congregation;
- Contact and identification details of your next-of-kin, or business staff including name, position, address and telephone numbers;
- Medical procedures and treatments that you as a practitioner or medical facility offer or have some level of experience in treating;
- Medical history of a patient including current and/or past medical treatments, conditions and medical test results;
- Patient medical treatment references and advance health directives;
- Answers you provide to questions asked by the Us or asked by a User of the Service (such as a HLC member);
- Other information you disclose in relation to your dealings with the Us or dealings with a User of the Service (such as a HLC member); and
- Usage statistics, errors and exceptions, some of which may include Personal Information.
You acknowledge that approved Users of the Service (such as a HLC member) may ask you for personal or sensitive information, including but not limited to your personal medical history, medical treatments, personal health care choices and advance health directives.
You are not required to disclose any personal or sensitive information to Us or a User of the Service, and you may request a User to the Service to not store specific Personal Information in the Service.
If you do provide Us or a User of the Service with Personal Information or information that is of a sensitive nature for any reason, you consent to the Service collecting that information and using and disclosing that information for the purpose for which you disclosed it to Us or a User of the Service and as permitted by the Privacy Act and other relevant laws. We never use or disclose your Personal Information for marketing purposes, please see section 6 and 7 for more information.
You have the right for your Personal Information to be removed and permanently forgotten. Please see section 13 for more information,
4. How do we collect your personal information?
The common ways your Personal Information is collected include:
- from contact (via email, telephone or other correspondence) with a HLC member or a User of the Service who has been approved by a HLC,
- from publicly available sources,
- from contact (via our website, email, telephone or other correspondence) with our Company staff, and
- from cookies used to provide and improve the Service.
5. Cookies
We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyse the Service.
You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies or block certain cookies, you may not be able to use some or all portions of the Service.

The data stored in this Service is subject to the guidelines used by each Hospital Liaison Committee. This includes what is data is collected, the length of time for which your Personal Information is stored, when it is removed, and how it is managed.

7. Do you use Personal Information for Marketing?
We do not and never will disclose, sell, trade, rent or share your Personal Information for advertising or marketing, or with third-parties for any other purpose except those described in Section 6. Users of the Service are prohibited from performing any of the aforementioned actions.
8. Who do we disclose Personal Information to?
We may disclose your Personal Information in connection with the purposes described in section 5 of this Privacy Policy:
- to Users of the Service that have been approved by a Hospital Liaison Committee,
- to the Company's employees, contractors or volunteers for the purpose of the development, maintenance and support of this Service,
- to any Third-parties to whom you have directed or permitted a User of the Service to disclose your personal information,
- to any Third-parties to whom you have directed or permitted the Company to disclose your personal information,
- to selected Third-parties for the purpose of providing the Service and to analyse and improve the Service,
- as otherwise as permitted or required by law.
9. Third parties
We use certain services from third-parties ("Third-parties") to provide the Service to you. Your Personal Information data may be stored and processed by these Third-parties:

- AppSignal: appsignal.com/privacy-policy
When disclosing your Personal Information to a Third party, we will use reasonable efforts to ensure that such Third parties only use your Personal Information as reasonably required for the purpose we disclosed it to them, and for the purposes for which it was collected, and in a manner consistent with Section 6 of this Privacy Policy and the Privacy Principles under the Privacy Act. Please refer to the relevant privacy policy of each Third-party.
You may request that your Personal Information is not stored by Third-parties. However, if you do so you will not be able to use the Service.
10. How long is my Personal Information kept?
In most cases Personal Information held about you is not stored permanently, and is only stored for the duration of the relevant Hospital Liaison Committee providing its services to you. For specific information please contact your local Hospital Liaison Committee.
Data used to analyse and improve the Service, including bug tracking, error handling and logging, tracing, and general usage statistics is retained for a maximum of thirty (30) days. At times when some Personal Information may be stored for the aforementioned purpose it only used to improve this Service. We use the third-party service AppSignal to store this data. 11. Where is my Personal Information stored?
We use the infrastructure and services supplied by Third-parties to host, store and process the data consumed by the Service in one or more of the following locations:
- Australia,
- European Union member countries, and the
- United States of America.
Your Personal Information and other data is encrypted at rest and stored in one or more of the following Third-party data centers in the aforementioned locations:

12. How do we protect your Personal Information?
The Company will take reasonable steps to keep any Personal Information held about you secure. Users of the Service agree to take all reasonable steps to keep Personal Information stored and processed in the Service secure.
13. How do I access my Personal Information or exercise my right to be forgotten?
You may seek access to Personal Information which we hold about you by contacting your local Hospital Liaison Committee, or us directly using the details below. We will provide access to that information in accordance with the Privacy Act, subject to certain exemptions which may apply.
You have the right to be forgotten, with all personally identifiable information about you permanently deleted from the Service. If you wish to exercise this right please contact us directly using the details below. We may require that the person requesting access or the right to be forgotten provide suitable identification.

14. Disclaimer of Liability
Neither We nor the Service are part of the legal organizations of Jehovah's Witnesses or the Hospital Liaison Committees of Jehovah's Witnesses, nor do we make any representations indicating otherwise.
Users of the Service are responsible for the Personal Information that is collected, processed and stored in the Service, including but not limited to the type of information, how it could identify a person, and the duration for which such information is stored.
Users of the Service must comply with this Privacy Policy, all local privacy laws and regulations applicable to them, and the privacy laws of Australia.
Except to the extent liability cannot be excluded due to the operation of statute, we exclude all liability (including in negligence) for the consequences of any unauthorised access to, disclosure of, misuse of, breach of privacy, or loss or corruption of your Personal Information.
15. Updates to this Privacy Policy
We reserve the right to update, modify, or revise these Privacy Policy at any time, at our sole discretion. Any changes will be effective immediately upon posting the updated terms on this website or through other means of notification, as applicable. It is your responsibility to review this Privacy Policy periodically to stay informed of any updates. By continuing to use the Service after any changes are posted, you agree to be bound by the revised Privacy Policy terms.
